This document defines the official diamond business terms and conditions governing loose diamond transactions, including sourcing, pricing, verification, manufacturing support, payments, logistics, and dispute resolution. All policies are designed to ensure ethical, professional, and secure B2B diamond trade operations.

Applicability of These Diamond Business Terms and Conditions

These diamond business terms and conditions apply exclusively to business-to-business (B2B) loose diamond transactions and professional diamond inquiries.
This website is not an ecommerce platform and does not sell finished goods or luxury products to consumers.

By placing an inquiry, purchase order, or advance payment with Ocean Star Diamonds Company, the Buyer confirms acceptance of these diamond business terms and conditions in full.

Scope & Acceptance of Diamond Business Orders

These Diamond Business Terms and Conditions govern all purchases, manufacturing services, and commercial transactions offered by Ocean Star Diamonds Company.

By placing an order for loose diamonds, lab-grown diamonds, moissanite stones, fancy color diamonds, or bespoke diamond cuts and wholesale orders, the Buyer agrees to:

  • Accept these diamond business terms and conditions without exception

  • Conduct all agreements strictly in written form

  • Acknowledge that verbal commitments are not valid

Order confirmation is considered legally binding once written approval or payment is received.

Pricing, Taxes & Diamond Rate Lock Policy

  • All prices are Ex-Surat (Gujarat).
  • GST is applicable as per law.
  • Diamond prices may change due to market movement.
  • International invoices (if applicable) will be issued in USD unless otherwise agreed.

Diamond Inventory Hold & Confirmation Policy

To maintain fairness in a fast-moving market:

  • A soft hold can be placed for 1–2 hours only.
  • If confirmation/payment is not received within the hold window, the stone will be released.
  • First confirmation (payment or written PO) receives the stone.
  • No rate lock beyond the hold window.

Mandatory Buyer Verification Before Diamond Dispatch

Before dispatch of any item (diamond, fancy stone, or moissanite), the Buyer must verify the following in writing:

  • Shape
  • Carat
  • MM Dimensions
  • Color / Any Tinge
  • Clarity
  • Cut / Polish / Symmetry
  • Fluorescence
  • Certification number
  • Included media (video/360°)
  • Final agreed price

Dispatch happens ONLY after written confirmation.
This protects both parties from disputes.

Diamond Return & Exchange Policy for Retailers

Our Diamond Business Terms and Conditions are designed to ensure fair and secure handling of diamond returns and exchanges.

Lab-Grown Diamonds (Certified & Non-Certified)

Returns are NOT accepted, except if:

  • Delivered stone does NOT match the verified written details
  • Wrong stone sent
  • Defective stone
  • Certification mismatch
  • No return for minor tinge/color variations already discussed.

Fancy Color Diamonds

Strict no-return policy, except in cases of:

  • Wrong dimensions
  • Wrong stone
  • Certificate mismatch
  • Shade variation (tinge difference) is not grounds for return.

Moissanite Stones

Strict NO return, except:

  • Wrong dimensions
  • Wrong item delivered
  • Damaged in transit

Bespoke Diamond Orders

No returns or exchanges.

  • Corrections will be made only for manufacturing defects reported within 48 hours.

Bespoke Diamond Order Terms

  • A minimum 10% advance payment is required for order confirmation
  • Two CAD revisions are provided free of charge
  • CAD approval is final and binding

After CAD approval:

  • If the Buyer cancels before casting begins, ₹2,000 is deducted and the remaining amount is refunded
  • If casting has started, the advance payment becomes non-refundable

Additional terms:

  • Full payment must be completed before dispatch
  • Weight variation of 5–7% is industry-standard and acceptable
  • Any changes after CAD approval are treated as a new order

Manufacturing Process Responsibility

Ocean Star maintains:

  • Verified diamond quality and calibration.
  • Professional cutting and polishing standards.
  • Secure and precise diamond handling.
  • Stones verified as per global laboratory norms.

Shipping & Logistics

Shipments are sent via secure logistics partners (DTDC, Angadia, DHL, etc.).

  • Parcels are insured until delivery.
  • Risk transfers to the Buyer after delivery is signed.
  • Delays caused by logistics, customs, or weather are beyond Seller control.

Payment Terms Under These Diamond Business Terms and Conditions

All financial transactions are governed by these Terms and Conditions to maintain transparency and payment security.

  • Cash (within government limits)

PDC: ONLY for verified retailers after 3 successful transactions

  • Maximum 15 days
  • Cheque bounce = immediate cancellation of credit + legal consequences

No Memo Policy

Ocean Star Diamonds Company does not provide memo or consignment under any circumstances.

This ensures:

  • Risk-free operations
  • No misuse of stones
  • Clean clarity in transactions

Liability & Certificate Disclaimer

  • Diamond certificates issued by independent laboratories such as IGI, SGL, and GIA are professional assessments.
  • Buyer must verify all details before dispatch.
  • Once verified and dispatched, the Seller is not liable for subjective grading opinions.
  • Seller is not liable for consequential or indirect damages.

Dispute Resolution

  • All disputes are governed by the laws of India.
  • Exclusive jurisdiction: Surat, Gujarat.

1. Product Information and Representation

  • 1.1. Diamond Grading and Certification: All loose diamonds and diamond jewelry sold are accompanied by a diamond grading report (“Certificate”) issued by an independent third-party gemological laboratory (e.g., GIA, AGS, IGI). The Certificate reflects the objective opinion of the issuing laboratory regarding the diamond’s characteristics at the time of examination.

  • 1.2. Natural Variations: Diamonds are natural products. Minor variations in measurement, weight, and visual appearance may occur.

  • 1.3. Imagery: Product images, including 3D models and videos, are for illustrative purposes only. The actual product’s color, size, and appearance may vary slightly due to screen settings, lighting, and the inherent nature of gemstones.

  • 1.4. Weights: Stated total carat weights for finished jewelry may be approximate and can vary by $0.05$ carats or $5\%$ (whichever is less) due to manufacturing tolerances.

2. Pricing and Payment

  • 2.1. Pricing: All prices are subject to change without prior notice. The price confirmed at the time of your order placement is final, subject to any technical errors or misrepresentations identified before shipment.

  • 2.2. Taxes and Duties: Prices listed may exclude applicable sales tax, VAT, duties, or other government charges, which will be added to the final invoice where applicable. The customer is responsible for all such charges.

  • 2.3. Payment: Full payment is required before an order is processed, unless otherwise agreed upon in writing. We accept [List accepted payment methods, e.g., Visa, Mastercard, Bank Transfer].

  • 2.4. Custom Orders and Deposits: A non-refundable deposit of 50% of the total price is required for all custom-designed or personalized orders.

3. Orders, Shipping, and Delivery

  • 3.1. Order Acceptance: An order is not deemed accepted until the Retailer sends an order confirmation email to the customer. We reserve the right to refuse or cancel any order for any reason.

  • 3.2. Shipping: Products will be shipped fully insured via a recognized and reputable courier service (e.g., FedEx, UPS).

  • 3.3. Delivery Signature: For security, all shipments require an adult signature upon delivery.

  • 3.4. Risk of Loss: Risk of loss and title for the Products pass to you upon delivery to the common carrier, provided the Retailer has fulfilled its obligation to tender delivery of the Products to the carrier. The Retailer remains responsible for the Products until the point of signed delivery.

4. Returns, Exchanges, and Refunds

  • 4.1. Standard Return Policy: You may return standard, non-customized Products in their original, unworn, and undamaged condition within 30 days of the delivery date for a full refund or exchange.

  • 4.2. Return Conditions:
    • The Product must be accompanied by the original sales receipt and the original, intact diamond Certificate. Loss of the Certificate will incur a replacement fee of \$250.
    • The Product must not have been resized, altered, or damaged in any way.
    • Any security tags or seals must be intact.

  • 4.3. Exclusions: Custom-designed jewelry, engraved items, special orders, and items showing signs of wear or damage are final sale and non-refundable.

  • 4.4. Refund Processing: Refunds will be processed within 10-14 business days after the Retailer’s gemological team has inspected and verified the returned item.

5. Warranty and Liability

  • 5.1. Limited Lifetime Warranty: We offer a Limited Lifetime Warranty covering manufacturing defects on all jewelry. This warranty specifically excludes:
    • Normal wear and tear (e.g., scratching, denting).
    • Damage caused by misuse, neglect, or accident.
    • Repair or service performed by a jeweler other than the Retailer. (Any external work voids this warranty.)

  • 5.2. Limitation of Liability: To the maximum extent permitted by law, the Retailer shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Products or Services.

6. Governing Law and Dispute Resolution

  • 6.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Gujarat, India.

  • 6.2. Dispute Resolution: Any dispute or claim shall be determined by binding arbitration in Ahmedabad, Gujarat, India.

7. Certificate Replacement

In the event a customer loses a diamond’s original Certificate, a non-refundable fee of \$250 will be charged to cover administrative and laboratory costs for replacement.
